TERMS OF REFRENCE

1. BACKGROUND
World University Service of Canada (WUSC) is a Canadian non-profit organization with a mission to foster human development and global understanding through education and training. We are a network of professionals, students, volunteers, faculty, and community leaders who, together, provide opportunities to some of the world’s most disadvantaged youth. Our programs and services improve access to and quality of education, expand employment opportunities and foster empowerment for youth. We work with and through our southern partners – government, civil society and the private sector.

Centre for International Studies in Cooperation (CECI) is a leader within an international network of partners combating poverty and exclusion. Our main area of expertise is in the building of development capacity of local partners in four main areas: sustainable economic development, food security, human security and emergency response, and gender equality. Present in several countries, the CECI contributes to improving the conditions of thousands of people and changing lives, every day.

WUSC and CECI have formed a consortium led by WUSC for the design and implementation of a West Africa Governance and Economic Sustainability in Extractive Areas (WAGES) project from April 2016 to March 2021. Working in partnership with communities, local government, mining companies, and other stakeholders, the project will enable communities, particularly women and youth, to maximize the socio-economic benefits from extractive resource investment in West Africa.

The project’s principal areas of focus include local governance, sustainable and inclusive economic growth, and regional knowledge-sharing on development best practices in mining areas. The expected results of the project include: increasing employment opportunities for community members, especially youth and women; ii) strengthening capacity of sub-national governments and local institutions to leverage opportunities arising from natural resource development, especially the extractives sector; and iii) increasing informed dialogue on local economic growth and governance strategies in regions with natural resource development activities, within the three target countries and across West Africa. This five-year CAD$20 million project is funded by Global Affairs Canada (GAC) through the ExCEED fund of Canada. 

In Ghana, the project is implemented in the Western Region, more precisely in the Prestea-Huni Valley District and the Wassa East Districts. 
The Prestea-Huni Valley District hosts five industrial mines and the Wassa East District hosts the Golden Star Wassa Ltd mine as well as small local artisanal gold miners called galamseys. 

The World University Service of Canada (WUSC) invites NGOs, consulting firms and independent consultants to submit proposals to lead in the development of a simplified dissemination toolkit on  mining regulations, policies and standards.  Consultants are expected to submit technical and financial proposals with an implementation timetable and their corporate and team resumes.         

2. OBJECTIVES OF THE REVIEW
The overall objective of this assignment is to develop a simplified but comprehensive Sensitisation Toolkit with illustrations/animations that would increase information available to mining communities on laws relating to mining. Knowledge of the mineral and mining laws as well as laws that govern mining activities within the mine catchment communities is very limited. Additionally, access to these laws and standards is sometimes difficult due to the technical language within which they are presented. Some mining communities have indicated that they do not attempt to have access to these laws because of the perceived difficulty in understanding them. This has deepened the apathy of the communities’ involvement in issues of communal wellbeing and the related issues of engagement with the mining firms. The Toolkit is intended to invite traditional leaders and the various identifiable entities within the communities and the communities as a whole to evaluate the practices of mining activities against national regulations on mining. It will take into account the Project’s cross-cutting themes which include; gender, youth and environment. The consultant shall work closely with the WAGES Project  Local Governance Specialist, GhEITI, the Minerals Commission, EPA and other relevant institutions deemed necessary. 

3. MANDATE 
The Project aims to strengthen the capacity of mining communities, improve collaborations between the actors in the mining industry, and increase the capacity of CSOs to facilitate access to information, disseminate information, and educate the public on the content of the mining laws.  

The mandate: 

  • Collect available information and data from relevant stakeholders including Minerals commission, EPA and EITI;
  • Identify and develop tools for assessing the understanding quotients of the communities.
  • Develop, with animations, an easy to understand simplified version of the regulations that would be used in community sensitization
  • Liaise with Minerals Commission, Chamber of mines and possibly the Environmental Protection Agency to ensure that the review of the regulations still leaves the reader with the needed understanding whilst not taking the vital information out. 

4.  DELIVERABLES: 
The specific activities of this assignment shall include developing a simplified sensitisation toolkit designed to enhance the knowledge of the mining communities, CBO’s, traditional leaders and elders, of the contents of the  Minerals and Mining Act and other  related legislation and for the purposes set out in section 2.

The consultant will in addition be responsible to:

  • Review mining related laws and existing sensitization tool kits .  
  • Visit and hold interviews with the Minerals Commission, Local Government officials and CSOs, that have developed sensitisation toolkits for mining communities.
  • Conduct visits and interviews with traditional leaders, opinion leaders, CSOs, Women and Youth Groups in selected mining communities on their level of understanding of the mining and mineral law and their access to these laws. 
  • Adapt and update these Toolkits for Sensitization. 
  • Prepare an outline of contents of the proposed toolkit submitted to the minerals commission and WAGES for approval.
  • Facilitate a validation meeting to present the draft Toolkit to be attended by representatives of Mineral Commission, the district assembly, EPA, CBO’s,  traditional authority as well as other stakeholder institutions among others. 
  • Write a report of the validation meeting.
  • Prepare and timely submit the Final Sensitisation Toolkit.

4.1 EXPECTED RESULTS
Expected results include;

  1. Sensitization toolkits made simpler and accessible to the mining communities.
  2. Increased collaborative efforts of all the actors involved in sensitization on the mining and mineral laws.
  3. Increased awareness on issues that relate to mining and mineral laws.
  4. Both the state and non-state actors oversight in sensitization programmes in mining communities improved.

4.2     COMMENCEMENT DATE & PERIOD OF EXECUTION    
The intended commencement date is 15th February, 2017. The period of execution of the contract will be 20 working days. Six (6) working days for review of existing Toolkits and meeting with relevant officials as well as developing and submission of the proposed outline of contents of the Toolkit. Six (6) working days to develop the draft Toolkit including one (1) day to present the draft at a validation meeting. Seven (7) days to deliver the final Sensitization Toolkit.

4.3.    REQUIREMENTS
All expressions of interest should include:
a)    A cover letter: A short (maximum three pages) letter addressing the base line criteria.
b)    Technical Proposal: A brief explanation about the Consultant with particular emphasis on the previous experience in related areas; profile of the Consultant and curriculum vitae, understanding of the ToR and the task to be accomplished.
c)    Financial Proposal: The financial proposal should provide cost estimates for services rendered including daily consultancy fees and a completed bio-data form. The proposal should also include estimates for accommodation, transport cost; stationery, supplies, printing and copying.  

4.5    PAYMENTS AND QUALITY ASSURANCE
The Program will make progress payments based on the percentages of the contract price set forth below upon submission of deliverables provided hereunder and acceptance. Progress payments will be made within mandated days of acceptance of each deliverable. See table below:

The responsible body shall be WAGES Project. The Consultant will report directly to the Local Governance Expert who will review all deliverables. The progress of the Consultant’s performance during the period of the assignment will be monitored and evaluated by the  Local Governance Expert through but not limited to progress meetings, telephone calls as well as review and acceptance of all deliverables prior to payment.

4.6          EVALUATION GRID

The consultant submitting the proposals shall be evaluated on the evaluation grid with table shown below.

5.  STUDY AREA
The area of study would be the two districts i.e. the Prestea Huni-Valley district and Wassa East district in the Western Region. 

6.  GENDER EQUALITY & YOUTH INCLUSION/HEALTH & SAFETY 
For the duration of the study, the selected consultant shall respect the Gender Equality (GE), as well as the health and safety standards of the project.

7.  ENVIRONMENT
Respect for the environment is one of the priorities of the project; the consultant must comply with environmental protection standards in the area of intervention of the project. They must also consider actions that contribute to the protection of the environment in their lines of action

Required Skills or Experience

4.4        EXPERTISE REQUIRED
 The following attributes are required for the selection of the Consultant:
a)    Postgraduate qualifications in human rights, law or a discipline relevant to this assignment with a minimum of 5 years work experience.
b)    Competence and experience in training and developing  mining related materials,
c)    Knowledge and experience in capacity building, community animations for communities.
d)    Proficiency in English, and
e)    Possession of excellent report writing skills.
